Got gold? Italy's Monte dei Paschi bank begins bail-ins for bond holders

Bail-ins can no longer be said to be limited to just Cyprus now as on Nov. 15, a major Eurozone country just facilitated the confiscation and subsequent haircut of bond holders owning the bank's subordinated debt.

Italy's albatross, and the world's oldest operating bank which goes back to the days before the discovery of the New World, was finally forced to capitulate to stave off insolvency by cutting staff and conducting a bail-in of certain bond-holders of the bank's debt.

Ever since the bank failed the ECB's latest stress test this summer, when it was advised that it needs to raise billions in capital, only to see the process fizzle with virtually no willing sources of new cash emerging due to the opaque labyrinth of the bank's bilions on NPLs, Italy's third largest, most insolvent, bank has been hoping to avoid a debt conversion, out of fears it may spook retail bondholders across the capital structure, and in other Italian banks, who may perceive the move even if touted as "voluntary" as a creditor bail-in. Which it technically is. 
Earlier today, the bank's board bet on Monday to set the terms for a bond-to-equity conversion that is part of the lender's capital boosting plans. As part of its sweeping restructuring, Monte Paschi was planning to lay off a tenth of its staff, shut branches and sell assets to win investor backing for a 5 billion euros ($5.4 billion) cash call, its third recapitalisation in as many years. The key part, however, due to the lack of new investor interest was the previously leaked voluntary conversion of its subordinated debt, whose successful execution would limit the amount of new funds needed.
So while we wait to learn if Monte Paschi will be successful in raising the critical outside cash, here is what Monte Paschi's bail-in, pardon debt conversion will look like, according to sources including Ansa, Bloomberg and Reuters: 
  • Monte Paschi approves voluntary debt-to-equity swap offer
  • Offer to target subordinated bonds for total outstanding amount of 4.289 billion euros; will offer between 20-100 percent of nominal value in bond swap offer
  • Holders of ~€4.5 billion of subordinated bonds will be able to convert them to shares
  • Bank is also considering possibility of launching conversion into equity of 1 billion euros of Fresh 2008 bonds
  • Senior bonds not included in the voluntary conversion plan
  • The bank is also considering conversion plan for EU1b of hybrid bonds
  • The conversion price is seen at 85% of nominal value for riskier Tier 1 bonds, according to Ansa sources.
  • The Conversion price is seen at 100% of nominal value for less risky Tier 2 bonds
  • Monte Paschi will acquire €700m of MPS Capital Trust II securities, also Tier 1, at 20%
  • It will also acquire seven series of BMPS subordinated debt at 100%

Monte Dei Paschi is not the only European bank experiencing insolvency issues, but they could be opening the door for institutions like Deutsche Bank to have to follow suit since EU rules negate the possibility of a government funded taxpayer bailout.

When you take into account what occurred late last week in India, where their government abruptly eliminated higher denomination bills to attempt to force their citizens to keep their money solely in a bank, and couple this with the instability of banks all across Europe, the world is once again teetering on the potential of another credit crisis, only this time it will be your money that is used to bail them out unless you learned the lessons of 2008 and have your wealth stored in something much more tangible.

The only real option if you offshore your money is to keep it in gold

If you take into consideration all the extreme monetary policies and capital controls instituted by governments and central banks over the past six years you would come to the realization that offshoring some or a large portion of your wealth is no longer a luxury, but a necessity.  But in many of these controls that several governments have created to try to monitor, tax, and even confiscate one's wealth if they try to protect it from devaluation, the only real option is to transfer it into some form of asset that is outside the banking system.

And more than any other facility possible, that option is gold.

Under current U.S reporting laws, if you own gold offshore in an individual name, it is not a requirement that you report it to either the IRS or the U.S Treasury. However, if the title of the gold is held in the name of a legal entity, it must be reported but if it is held in your offshore account, it is reportable. So, owning and holding gold in an offshore account is completely legal. 
There are several reasons why people use offshore accounts to own and store gold. These include offshore confidentiality, protection, tax planning, privacy, and investment diversification among other things. A carefully planned and executed offshore account can assist you with each of the areas mentioned above. Au contraire Virginia, Congress can evoke bailouts during any financial crisis

In the aftermath of a negative public reaction to the bailing out of banks with taxpayer money following the 2008 Credit Crisis, Congress passed a law in which future crises in the financial system would be settled using the bank’s own customer accounts in what would become known as a bail-in procedure.
Yet on June 13, the possibility of a taxpayer bailout of a financial institution or sovereign government came back to the forefront as the Supreme Court ruled today that the territory of Puerto Rico does not have the authority to default on their debts, and only Congress has the power to legislate bailouts to aid or satisfy the obligations.

Bank of Montreal initiates final processes for their gold fund program

Last year, the Bank of Montreal (BMO) announced plans to start a new gold fund which would allow investors to partake in the buying of physical gold, while having greater protections than would normally be seen in a private vaulting company.

But unlike the GLD and SLV ETF metals funds on the American stock exchanges, this fund by BMO would easily allow clients to withdrawal their gold at any time.

And on June 7, BMO filed a prospectus with the SEC to fund the new program with $500 million in physical gold bullion, in preparation for clients and investors to begin changing their currency into precious metals.

A year ago February, Bank of Montreal announced plans to start a physical gold fund -

— and today the bank filed a prospectus with the U.S. Securities and Exchange Commission signifying intent to stock the fund with $500 million of gold, to denominate the shares in ounces, to vault the metal at the Royal Canadian Mint, and to give investors the option of withdrawing their investment in real metal:

The prospectus provides a few interesting and even amusing details: 
— It cautions that the “official sector” is active in the gold market and can affect prices, an acknowledgment that will never make it into any reports by mainstream financial news organizations. 
— The fund will not insure its assets, trusting the Royal Canadian Mint to protect them. 
— The fund is structured separate from the Bank of Montreal so that its assets will not be vulnerable to claims by creditors against the bank. 
The amusing part — the fund seeks to eliminate “derivatives risk (i.e., the use of unallocated gold, gold certificates, exchange-traded products, derivatives, financial instruments, or any product that represents encumbered gold),” as well as “’empty vault risk’ or gold bullion lending risk (i.e., the practice of the gold custodian lending, pledging, hypothecating, re-hypothecating, or otherwise encumbering any of the investors’ underlying gold bullion).” - Gata via Silver Doctors
Interestingly, the Bank of Montreal is going above and beyond to ensure that investors know of the perils within the banking system that currently allows institutions to confiscate customer accounts in the event of insolvency by the bank itself, and that this new gold fund does not fall under the parameters of those bail-in procedures.  In essence, the fund is not only a signal of the importance and need for gold diversity, but that it will appeal greatly to the growing number of citizens realizing that trusting their wealth inside banks is a losing proposition.

Is there any security in the markets that Deutsche Bank didn’t manipulate?

As more information comes out regarding the investigation into Deutsche Bank, we have to wonder if there are any securities out there that the German investment bank didn’t rig and manipulate.  That is because on top of the acknowledgement last month that they rigged the gold and silver markets for several years, on May 23 it has now been verified that Deutsche Bank also rigged stocks.
Since the U.S. began allowing corporations and banks to function outside GAAP, and mark to market accounting, many of these entities use holding companies to dump bad assets into during times when they are to report earnings.  This of course inflates the value of the bank or business, and perpetuates false shareholder values and unjustifiable bonus distributions.
But eventually all reporting, both honest and fraudulent, comes to light and it appears that securities going back to 2013 were hidden to help Deutsche Bank’s balance sheet look better than it actually was.

Major banks desperate for liquidity want you to open new accounts

An interesting thing happened along the way to insolvency for major banks dependent more upon zero interest rate borrowing from the Fed than from everyday depositors.  And that being, the banks now desperately want your money and are willing to pay for it.
Within the past few weeks, both Goldman Sachs and Deutsche Bank are offering between 1-5% yields for simple savings accounts when for the past seven years depositors were not only receiving less than 1%, but the days of free checking were now long over.

Negative interest rates in Europe lead Austria to highest gold sales in history

While the U.S. and most of the Western economies talk down gold and the need to protect your wealth in a physical asset, one sector of the Eurozone is setting new records for physical gold sales in the wake of negative interest rates.

In 2015, the nation of Austria set a new record for gold sales, with a 215% increase over the previous record set one year earlier.  And their 1.3 million ounces sold was greater than all sales made between the U.S. and Australia mints combined.


The Austrian Mint sold 1.3 million ounces of gold in 2015. This was up 215% from 2014 when the Austrian Mint sold 910 million ounces of gold. Austrian Mint gold sales in 2015 exceeded the combined 2015 U.S. Mint American Gold Eagle and Perth Mint gold sales. 
Austrian Mint spokeswoman Andrea Lang told Bloomberg News that the Austrian Mint’s gold sales were a reaction to the negative interest rates instituted across the European Union. A common knock against gold is that it doesn’t pay interest. That complaint is neutralized when gold is compared against cash deposits, which lose money by remaining in bank accounts and are subject to potential “bail-ins” whereby depositors may lose some of their deposits if the banks where they keep their money become insolvent. 
Gold was the best performing asset in the first quarter of 2016 and the Austrian Mint expects sales to remain strong through 2016. Indeed, in the first quarter of 2016, the European Central Bank announced additional stimulus and took interest rates further into negative territory. Got gold? Bank bail-ins have returned, and are beginning in Austria

Last year saw a mad rush by Western governments, especially in the Eurozone, to pass bail-in legislation before the end of 2015.  And while the European Central Bank has done its part in attempting to buy every single toxic debt that was on the books of European banks, it hasn't been enough to satisfy the trillions in loans made to subsidize the oil industry, emerging markets, or artificial bubbles in sectors like housing.

And it appears that these new laws came none too soon as on April 10, Austria invoked their bail-in procedure and will initiate a debt haircut on senior creditors for a failed bank that was nationalized six years ago.

Today, the Austrian Financial Market Authority (FMA) in its function as the resolution authority pursuant to the Bank Recovery and Resolution Act (BaSAG - Bundesgesetz über die Sanierung und Abwicklung von Banken) has issued the key features for the further steps for the resolution of HETA ASSET RESOLUTION AG. The most significant measures are: 
•a 53.98% bail-in, resulting in a 46.02% quota, for all eligible preferential liabilities, 
•the cancellation of all interest payments from 01.03.2015, when HETA was placed into resolution pursuant to BaSAG, 
•as well as a harmonisation of the maturities of all eligible liabilities to 31.12.2023. - Examiner

Canada preparing for bail-ins as collapse of oil industry forces new legislation in their budget

On March 22, Canada's new ruling party submitted their budget for fiscal year 2016-17, and hidden within it was new legislation to approve of depositor bail-ins for banks that might become insolvent.  And with the Canadian oil industry in fill collapse due to lower oil prices, the leverage by the banks in the energy industry is pushing them closer and closer to default.



Introducing a Bank Recapitalization "Bail-in" Regime 
To protect Canadian taxpayers in the unlikely event of a large bank failure, the Government is proposing to implement a bail-in regime that would reinforce that bank shareholders and creditors are responsible for the bank’s risks—not taxpayers. This would allow authorities to convert eligible long-term debt of a failing systemically important bank into common shares to recapitalize the bank and allow it to remain open and operating. Such a measure is in line with international efforts to address the potential risks to the financial system and broader economy of institutions perceived as “too-big-to-fail”. 
The Government is proposing to introduce framework legislation for the regime along with accompanying enhancements to Canada’s bank resolution toolkit. Regulations and guidelines setting out further features of the regime will follow. This will provide stakeholders with an additional opportunity to comment on elements of the proposed regime. 
Bail-in Regime for Banks 
Canada’s financial system performed well during the 2008 global financial crisis. Since that time, Canada has been an active participant in the G20’s financial sector reform agenda aimed at addressing the factors that contributed to the crisis. This includes international efforts to address the potential risks to the financial system and broader economy of institutions perceived as “too-big-to-fail”. Canada following India in trying new scheme to get people to trust banks with their gold and silver

In November of last year, the government of India attempted to lure their citizens into depositing their physical gold into banks with the enticement of an interest bearing gold savings account.  However, barely a few tons were garnered from the people for this scheme showing that distrust in both the banks and governments to actually protect their gold is quite high.
And now just days after the Canadian government sold off most of its remaining gold reserves, a Canadian physical gold distributor, Canadian Bullion Services, is channeling its inner India and attempting to entice the Canadian people to follow the same path with their own offer of an interest bearing gold savings scheme.

Banks take advantage of interest rate hike to raise borrowing costs without upping interest to depositors

Almost immediately after the Federal Reserve raised the discount rate from near zero to .25%, banks began to raise the cost of borrowing for mortgages, credit cards, and other loans.  In particular, Wells Fargo, PNC, and JP Morgan banks raised their prime borrowing rates to 3.5% less than five minutes after Chairman Yellen’s announcement.
But while the cost of borrowing from banks is increasing, the opposite end appears not to be, and that is interest paid to depositors from which banks use in their lending to make profits at that prime plus rate.

Some have multiple bitcoin addresses, but such a spike suggests there are new users as well. 
Most bitcoin experts once again see Chinese demand as key.  As China has been devaluing its currency, the yuan, throughout the year and the Chinese are aware of the growing risks posed to the yuan and indeed the dollar and other fiat currencies. 
Also, their recent experience of the stock market crash has made bitcoin and, of course, gold more attractive again. Hence the surge in demand for gold in China again. China’s gold buying rose 7.83% year on year to 814 tons in the first three quarters, industry data from the China Gold Association (CGA) showed yesterday. 
Bitcoin is an easy way for people to swap out of yuan. Goldman Sachs analysts estimated earlier this year that 80% of bitcoin volume is exchanged in and out of the Chinese yuan. Once converted to bitcoin, the owners can then swap back into other fiat currencies and indeed, physical gold. - Goldcore
The fascinating dichotomy going on right now is that while the price and value of Bitcoin is increasing, and more than doubling from its August lows, the price of gold in dollars has been crucified, and as of today, pushed down below $1100 for the first time in months.  This arbitrage from Yuan to Bitcoin to Gold will only tighten the already short supply of gold in the markets, and lead the world into the eventual showdown that will wrest control from the corrupt Western banks that have manipulated the price to the point that there are now more than 290 paper claims for every single ounce of gold in the Comex markets.  (Comex uses this market to determine global gold prices)


And while the Chinese people are seeking new ways to offshore their money, and to get it into something of real value, for the rest of the world, the majority of the global population outside of China is not in Bitcoin, and few have any real desire to be a part of the crypto-currency revolution.  Yet at the same time many of these people have come to the realization that the paper fiat system of money and banking is dying, and that they need to find a way to protect themselves from the coming policies of negative interest rates, the banning of cash, and potential bail-ins that are all now par for the course when the next financial crisis finally hits.

U.S. banks are going to new lengths to ward off a surprising threat to their financial health: big cash deposits. 
State Street Corp., the Boston bank that manages assets for institutional investors, for the first time has begun charging some customers for large dollar deposits, people familiar with the matter said. 
J.P. Morgan Chase & Co., the nation’s largest bank by assets, has cut unwanted deposits by more than $150 billion this year, in part by charging fees.
The developments underscore a deepening conflict over cash. Many businesses have large sums on hand and opportunities to profitably invest it appear scarce. But banks don’t want certain kinds of cash either, judging it costly to keep, and some are imposing fees after jawboning customers to move it. 
The banks’ actions are driven by profit-crunching low interest rates and regulations adopted since the financial crisis to gird banks against funding disruptions. 
The latest fees center on large sums deemed risky by regulators, sometimes dubbed hot-money deposits thought likely to flee during times of crises. Finalized last September and overseen by the Federal Reserve and other regulators, the rule involving the liquidity coverage ratio forces banks to hold high-quality liquid assets, such as central bank reserves and government debt, to cover projected deposit losses over 30 days. Banks must hold reserves of as much as 40% against certain corporate deposits and as much as 100% against some deposits from hedge funds. - Wall Street Journal

Not everything is "fine" in the land of European banks, in fact quite the opposite. 
One day after Deutsche Bank warned of a massive $7 billion loss and the potential elimination of the bank's dividend which had been a German staple since reunification, a move which many said was a "kitchen sinking" of the bank's problems (but not Goldman, which said it was "not a kitchen sinking, but a sign of the magnitude of the challenge" adding that "this development confirms our view that the task facing new management is very demanding. Litigation issues do not end with this mark down - we expect them to persist for a multi-year period. We do not see this as a "clean up" but rather an indication of what the "fixing" of Deutsche Bank will entail over the 2015-18 period), it was the turn of Switzerland's second biggest bank after UBS, Credit Suisse, to admit it too needs more cash when moments ago the FT reported that the bank is "preparing to launch a substantial capital raising" when the new CEO Thiam unveils his strategic plan for the bank in two weeks’ time. 
FT adds that "while not specifying an amount, they pointed to a poll published last week by analysts at Goldman Sachs concluding that 91 per cent of investors expect the Swiss bank to raise more than SFr5bn in new equity."
The most concerning question one needs to ask is, with the European Central Bank (ECB) running at negative interest rates for their borrowing facility, why wouldn't these banks use this option to borrow massive amounts of euros to stabilize their own institutions?  As of now we have no answer, but on the surface it appears that the Eurozone's bank of last resort isn't as capable as many think, and this leaves banks like Deutsche and Credit Suisse to seek different avenues to deal with their growing and accelerating insolvencies.
*to note - Switzerland is not part of the European Union, but up until recently, their currency had been pegged to the Euro, so access to the ECB in some form was allowed in their banking system.

Yet as a side note to see just how dire Deutsche Bank's problem's are, the German central bank (Bundesbank) issued a press release just this morning announcing their updated gold reserves, and how much gold they expect to receive in future years from repatriation.  This drastic announcement signifies just how much in trouble the German banking system is, especially as they attempt to quell concerns by showing their gold holdings as a collateral backstop.
Over US$100bn in estimated gross exposures to Glencore 
We estimate the financial system's exposure to Glencore at over US$100bn, and believe a significant majority is unsecured. The group's strong reputation meant that the buildup of these exposures went largely without comment. However, the recent widening in GLEN debt spreads indicates the exposure is now coming into investor focus.

$100 billion in unsecured liabilities is not catastrophic unto itself, but Glencore is a commodity desk that trades in an immense amount of derivatives that have counter-parties all around the world.  Those counter-parties are the same ones that had derivatives tied to Lehman Bros. back in 2008, which of course takes this simple sum of $100 billion and multiples it by factors of hundreds or even thousands.

Uninsured deposits are those in a bank that are more than $250,000 for a single account.  However, one has to take into consideration that under the Dodd-Frank bill, and under recent FDIC regulations, derivatives are given a much higher priority for payment than your checking or savings account, and as of right now there is only $25 billion in the FDIC to cover over $9 trillion in bank accounts, and $303 trillion in derivatives.

What will 50% of the American population do when the government checks stop coming?

When you take into consideration all the welfare programs, unemployment insurance, disability payments, and social security, over 50% of the entire population of the U.S. is on some form of government aid.  And as our national debt is well over $18 trillion and the annual deficit well over $1 trillion, how long will it be before the government has to cut off many of these promised payments because they can't afford to fund them through taxes and other revenues?  In fact, this doesn't even count the $2 trillion that the states are behind in funding their own pension programs.

Yes Virginia, contrary to ECB rhetoric there will be a Greek depositor bail-in

After Greece changed course back in July and accepted the Troika’s demands for austerity measures to receive a new bail-out, the assumption was that only bond holders would be subject to any sort of risk that might see their securities decline, or perhaps even fall to zero.  Yet as one knows in the financial industry, and in the case of central bank policies, you can never fall asleep believing that your money is ever safe.
According to EU legislation that is in line with January’s G20 resolution, and is similar to Section II of America’s Dodd-Frank laws, starting on Jan. 1 any and all bank deposits within Greece (and the rest of the Eurozone) can and will be subject to confiscation and bail-ins to re-capitalize their banking systems.  And with these banks having already seen over $100 billion removed by depositors prior to the Greek bank holiday, it is fair to assume that these banks are already close to insolvent, and won’t be waiting long to allocate the people’s deposits towards funding their own deficiencies.

Depostors bank account’s are now eligible to pay Goldman Sach’s bonuses when the bail-in comes

Back in 2008, the public went wild over the government’s use of taxpayer money to bail out insolvent banks who had speculated and lost during the Housing Bubble bull market.  But even this was not as critical as the rage the American people felt when these same banks gave their executives massive bonuses based on capital received from that bail out.
And now seven years later, one of the major culprits who should have gone the way of the dodo bird is setting up to one day fleece the American people once again, only this time it will be under the auspices of the now infamous Dodd-Frank legislation that allows for depositor bail-ins during a monetary or banking crisis.
That culprit is none other than Goldman Sachs, who on Aug. 13 just added commercial banking to their repertoire by acquiring GE Capital Bank (“GECB”), and their $8 billion of online deposits.

On July 20, a new report out of Germany was published that shows that the government is working to deactivate a 23 year old service known as Maestro which allowed citizens to link their bank accounts directly to a debt card, which was backed by MasterCard, and usable anywhere around the world, and in any currency they needed.

The game is afoot to eliminate CASH. According to reliable sources, Maestro is seriously under attack. In Germany, Maestro was a multi-national debit card service owned by MasterCard and founded in 1992. Maestro cards obtained from associate banks and can be linked to the cardholder’s current account, or they can be used as prepaid cards. Already we see the cancellation of such cards and the issuing of new debit cards. Why? The new cards cannot be used at an ATM outside of Germany to obtain cash. Any attempt to get cash can only be an advance on a credit card.

Yet as I noted at the beginning of this article, banking and monetary restrictions are occurring in BOTH Germany and Greece.  And after citizens nearly drained their banks of all their reserves a month before the bank holiday was announced, Greek banks are now begging their people to put their money back into the banks, and trust that access to their money won't be hindered.

President of Greek Banks Association Louka Katseli appealed at the citiznes to return their money to the banks. “Banks are absolutely trustworthy,” Katseli told Mega TV as guaranteed by the ECB and the Bank Association, but they would have been even more powerful if 40 billion euros had not been withdrawn in the last months.

Katseli, a former PASOK Minister, appealed to citizens to return their deposits  to the banks “now that the banks are open” after a three-week holiday and capital controls. - Keep Talking Greece

According to in-house memos now circulating, the DHS has issued orders to banks across America which announce to them that “under the Patriot Act” the DHS has the absolute right to seize, without any warrant whatsoever, any and all customer bank accounts, to make “periodic and unannounced” visits to any bank to open and inspect the contents of “selected safe deposit boxes.”

Further, the DHS “shall, at the discretion of the agent supervising the search, remove, photograph or seize as evidence” any of the following items “bar gold, gold coins, firearms of any kind unless manufactured prior to 1878, documents such as passports or foreign bank account records, pornography or any material that, in the opinion of the agent, shall be deemed of to be of a contraband nature.” - Investment Watchblog

And of course, with the financial and monetary systems showing cracks in recent weeks, how long until the next liquidity crisis facilitates the implementation of Dodd-Frank legislation allowing for banks to confiscate your bank accounts to recapitalize their losses under a bail-in scenario?
